This is a legally binding contract with the purpose of protecting the Seller, Buyer and the puppy/ dog.

Congratulations on your new puppy!  The parents of your puppy are both excellent working and/or show Rottweilers.  This litter was bred with the intent to better the Rottweiler breed.  Should you, the buyer, at any time prior to taking possession of your puppy should change your mind it shall be understood that any deposit paid shall remain on record to be used towards a purchase at any later date.  Though non-refundable, any deposit shall remain valid indefinitely.  As breeders, it is our hope that you will take exceptional care of this puppy throughout its entire life.  This means providing socialization, medical, proper nutritional, physical needs as necessary, treating your dog as part of your family, and giving it lots of love for the remainder of its life.   If for any reason you are unable to keep this puppy please contact us first.  We will accept one of our offspring back. We do not repurchase or "buy back" dogs unless under the terms of our "right to first refusal" clause contained herin.  Remember that environment and how it raised has tremendous impact on how the dog will turn out.  It is important that all Rottweilers get obedience training at an early age. Buyer agrees to perform, or hire someone to perform training of the dog/puppy appropriate to the needs of the home.

We stress the importance of leadership, guidance and training be provided to the puppy / dog by the new home.

Seller certifies that said puppy is in good health to the best of Seller’s knowledge.  Buyer has 72 hours after purchase to take puppy to a veterinarian.  If upon examination the veterinarian finds that said puppy is not in good health, the Buyer must notify the Seller within 24 hours.  Buyer shall return the puppy to the Seller with all of the veterinarian documentation.  Seller shall replace said puppy with another puppy of equal value as soon as one is available. 

The Buyer agrees that any and all transportation at any and all times, to and/or from the Seller’s premises, will be at the cost and sole responsibility of the Buyer.

The Buyer agrees to have said puppy/dog micro-chipped (if not yet completed upon purchase) and the chip id number shall be provided to Seller by registered mail within 60 days of purchase.

The Buyer agrees to maintain preventative health care of the puppy including, but not limited to: supplemental folic acid, supplemental calcium and potassium (plain yogurt given daily recommended) inoculations, internal as well as external parasites, heart worm preventative medication.

The Buyer agrees to maintain preventative care of the puppy in regards to hip dysplasia, such as proper nutrition, proper exercise, and preventing stress injuries (ie. Not allowing the puppy to jump from heights taller than itself at the shoulder, no forced exercise such as running, no climbing stair cases, until at least 12 months of age.)

Only after the full amount of the agreed upon amount is paid, may the puppy be removed from the Seller’s premises.  If the balance is left unpaid by such date as of  30 days from contract this agreement shall be canceled at the Sellers’ option and the Buyer shall forfeit the deposit given hereunder unless otherwise agreed upon. Any changes to this time line that have been mutually agreed upon shall be entered and initialed by both parties.

This agreement is made and signed by both parties to insure the well being and protection of this animal.  If any part of this agreement is breached, the Seller is released from any further obligation hereunder.

Should the Seller need to seek legal action against the Buyer for violations of this agreement, the Buyer will assume any and all attorney costs and court fees. This contract must be presented to seller for any guarantee of any kind to be in effect.

            PET QUALITY:          

            The Seller guarantees that said puppy will be free of crippling hip dysplasia for up to (5) five years.  Any puppy unable to function as a household pet due to canine hip dysplasia must be diagnosed as such by the OFA, or our specialist, Dr Link in Madison Wisconsin.  Buyer must present all documentation along with x-rays, this contract, and the said puppy/dog to the Seller. When a puppy of equal value is available, replacement shall be made. (VKW reserves the right to have canine in question evaluated by a qualified veterinarian to validate any claim associated to this warranty)  No refunds will be offered.

            SHOW QUALITY:

            Said puppy is guaranteed not to have any disqualifying faults according to the American Kennel Club (AKC) Standard.  If said puppy is disqualified from an AKC conformation ring by two (2) different judges due to conformation and proof of such disqualification is presented to Seller, said puppy shall be replaced with another show quality puppy for the price of a pet quality puppy.  Said puppy is also guaranteed to qualify and receive and Orthopedic Foundation for Animals (OFA) certificate of “Fair” or better after presentation of the required x-rays that shall be provided by the Buyer at the age of 24-30 months of age.  Should said puppy be denied such certificate due to canine hip dysplasia Seller shall replace said puppy with another show quality puppy for the price of a pet quality puppy. Buyer shall return said dog and sign dogs AKC papers back over to Seller before a replacement will be made by Seller. (VKW reserves the right to have canine in question evaluated by a qualified veterinarian to validate any claim associated to this warranty)  No refunds will be offered.

In the case of both pet and show quality in regards to hip dysplasia, a second opinion shall be sought by Buyer prior to replacement of puppy/ dog. This second must be by a specialist in the field of canine hip evaluation. Seller reserves the right to have Sellers specialist review all documentation including x rays and full medical records.

    Temperament Guarantee 5 Years:

 Dog may be returned to Seller for replacement if canine in question has a temperament that is proven to being inappropriate for the home conditions at the time of purchase. Meaning: If the dynamics of the home change we can not be held responsible for replacement of the dog. Buyer agrees to properly socialize said puppy, and attend obedience classes with dog while under the age of 4 months and above the age of 6 months and will provide documentation of said training. Dog must be intact, in proper health and condition, and have been seen routinely by a veterinarian. Seller reserves the right to have said dog evaluated by a professional veterinarian, dog trainer or behaviorist to validate and claim associated with warranty. Dog must be returned with AKC registration signed back to Seller and medical records provided to Seller prior to replacement.

The Buyer agrees NOT to start Schutzhund Bite / Protection Training of this animal, until it has reached a minimum of 8 months of age.  (Thus allowing the animal the physical as well as mental maturity level not to harm or damage the animal. The Buyer agrees that he/she is not acting as or in part of, an agent in the purchase of this puppy and that the Buyer will not sell this puppy or any of it’s progeny to any agent, pet store, or guard dog business.

The Buyer agrees that should it become necessary to sell or otherwise place this puppy/dog, the Buyer will notify the Seller in writing by certified mail before taking such action so that the puppy/dog may, at the Seller’s option, be purchased back by the Seller at original price, less deposit. Buyer is responsible for all shipping charges. Upon receipt of notification, the Seller shall have 21 working days to exercise said re-purchase option.  Exercise shall be notice in writing (to include, but not limited to email) sent to the Buyer. 

The Buyer agrees that the Seller may repossess the animal upon evidence of neglect and/or abuse at no expense to the Seller, and no refund and any monies. Said neglect shall be determined in accordance with the laws within the buyers county of residence.

 The Buyer agrees that the puppy will reside at the home of the Buyer, and not be chained or “tied out”.  This animal is sold with the understanding that it was to go to select homes, be socialized properly, and become a member of the family. Buyer understands that every puppy needs training and socialization.

Buyer agrees to release and hold harmless Seller for any and all liability, damages, or injuries, caused either directly or indirectly by Puppy to any person, animal, whether actual or legal, or to any property whether real or personal.  Furthermore, Buyer assumes full liability for any damages or injuries, whether physical or mental, emotional or economic, caused by Puppy, to any person whether actual or legal, or to any property, whether real or personal, after receiving and acknowledging delivery and possession of Puppy.

The Buyer agrees that this animal will not be used for breeding purposes to another Rottweiler (which must meet the following criteria as well ) either registered with the AKC or other certified dog registry (ADRK, UKC, CKC) and only after it has passed the following proof thereof:

            1.) Official certification for hips by OFA, OVC, Penn Hip, or equivalent.

            2.) Current negative Brucellosis report from Veterinarian.

            3.) All inoculations and worming up to date.

Should the Buyer breed the animal before ALL the requirements listed in this section are met, the Buyer acknowledges the Seller’s right to execute their right to repossess the animal that this contract pertains to.  If the animal in question is a bitch, the Seller may also repossess any and all offspring derived from the breeding in question.  There will be NO refund and any monies paid and will be left to the Seller’s discretion as to the placement of the animal and any of its offspring. There shall be no refund of purchase price for said puppy nor will a puppy of greater value be given as replacement. 

If a show quality male is purchased, Seller reserves the right to breed any female owned, co-owned  or leased by the Seller to said male at no charge.

This contract shall be deemed a legal and binding agreement between Seller and Buyer and is under the jurisdiction of the State of Missouri in the county of Lincoln.  It is further agreed that should any dispute/arbitration between Seller and Buyer regarding said puppy/dog occur that the legal venue shall be the County of Lincoln, Missouri. 

Any mutually agreed amendments to this contract shall be entered below this point of contract with initial of both parties.
